Know what you own
Sectional title or full title? It changes how the sale works.
Most flats are sectional title. Townhouses can be either. Pick yours to see what it means when you sell.
- What you own
Sectional:Your unit (the section) and a share of the common property. A garden, parking bay or storeroom may be yours as an exclusive use area.
Full title:The building and the land (erf) it stands on, often inside an estate with shared roads and gates.
- Monthly costs
Sectional:Levies to the body corporate, plus your own municipal rates.
Full title:Your own rates, plus homeowners’ association (HOA) levies if the estate has one.
- Who runs it
Sectional:The body corporate’s trustees, usually with a managing agent.
Full title:You. If there’s an HOA, it runs the shared parts under its constitution and estate rules.
- Before transfer
Sectional:A levy clearance certificate, which the attorneys get from the managing agent or trustees.
Full title:An HOA clearance certificate, if there’s an HOA.
- Certificates
Sectional:An electrical certificate for your unit. Roofs and fences are usually common property, so the body corporate looks after those. A plumbing (water installation) certificate may also apply under the City’s by-law. We’ll confirm what your scheme needs.
Full title:Much the same as a freestanding house. See the certificates for selling a house
- Buyers will ask for
Sectional:The levy statement, conduct rules, latest AGM minutes and the reserve fund balance.
Full title:The estate rules, the HOA levy and any building guidelines.
Not sure which you have? Your title deed says. Or ask us at the valuation.

Your ticks stay on this page only. Nothing is saved or sent.

Get my free valuationWho pays the levies until the unit is transferred?
You do, until the unit is registered in the buyer’s name. To issue the clearance certificate, the body corporate usually wants levies paid up to the expected transfer date. The attorneys then settle the difference between you and the buyer on transfer.
Can I sell while a special levy is being paid?
Yes. Who pays the rest of it is agreed in the offer. Tell us about it early and we’ll make sure the offer says so clearly.
Can I sell my flat with a tenant living in it?
Yes. A lease generally carries on after a sale, so the buyer takes over as landlord until it ends. Investors often like a unit with a good tenant. Buyers who want to move in will ask when it’ll be empty.
Do the trustees have to approve my sale?
In an ordinary sectional title scheme, no. The attorneys need a levy clearance certificate to transfer, but the trustees don’t choose your buyer. Some retirement schemes and estates have their own rules, so we check yours.
My townhouse has an erf number. Is it full title?
Probably, but check the title deed. A sectional title unit is described by a section number and a scheme name. We’ll confirm which yours is at the valuation.
Will buyers pay less because of a high levy?
Buyers add the levy to their bond repayment, so it does affect what they can afford. A higher levy that pays for security, a pool or a well-kept building can still be good value. We compare your unit with recent sales in the same and nearby complexes.
